Introduction

Welcome to Bibiis. These Terms of Service ("Terms") govern your use of the Bibiis platform, including the web application, mobile application, and all related services (collectively, the "Service"), operated by NVP Tech Srls, a company registered in Italy ("we", "us", "our", or "Bibiis").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Description of the Service

Bibiis is a personal finance management platform that provides:

Multi-bank account aggregation via open banking (PSD2)
Automatic transaction categorization powered by artificial intelligence
Financial dashboard with overview of income, expenses, and net worth
Automatic detection of recurring payments and subscriptions
AI-powered financial assistant for analysis and questions about your data
Financial goal setting and tracking

No Financial Advice

IMPORTANT: Bibiis is NOT a financial advisor, asset manager, financial intermediary, or credit institution. Bibiis does not provide financial, tax, legal, or investment advice of any kind. We do not manage, invest, transfer, or hold money or assets on behalf of users.

No advisory services: All information, analyses, categorizations, and insights provided by Bibiis are for informational and personal organizational purposes only. They do not constitute and should not be interpreted as financial, investment, tax, or legal advice.
No asset management: Bibiis does not manage, invest, transfer, custody, or hold money, securities, or any other financial assets on behalf of users. We do not have transactional access to your bank accounts: we access them exclusively in read-only mode to retrieve balances and transaction history.
No decision-making responsibility: Any financial decision made by the user based on information displayed on Bibiis is the sole responsibility of the user. We recommend consulting a qualified professional before making important financial decisions.
AI assistant: The AI financial assistant integrated into Bibiis provides analyses and responses based on your transaction data. Its responses are automatically generated and do not represent professional advice. The AI may make mistakes.

User Account

4.1 Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4.2 Age Requirements

You must be at least 18 years old to use Bibiis. By using the Service, you represent that you are at least 18 years of age.

4.3 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other security breach. We will not be liable for any losses arising from the unauthorized use of your account.

Bank Connection and Open Banking

Bibiis uses authorized Account Information Service Providers (AISPs), regulated under PSD2, to connect to your bank accounts in compliance with the PSD2 Directive.

Access to your banking data is exclusively in read-only mode (Account Information Services)
We cannot make payments, transfers, or any transactional operations on your accounts
The bank connection requires your explicit consent and can be revoked at any time
Your banking login credentials are never stored on our servers: authentication takes place directly through your banking institution

Use of the Service

6.1 Permitted Use

You agree to use the Service exclusively for managing your personal finances and in compliance with applicable laws.

6.2 Prohibited Use

You may not:

Use the Service for illegal, fraudulent, or unauthorized purposes
Attempt to access other users' data or our systems in an unauthorized manner
Reproduce, distribute, or create derivative works from the Service without written authorization
Use automated systems (bots, scrapers) to access the Service
Interfere with the operation of the Service or compromise its security

Paid Plans, Billing and Right of Withdrawal

Paid plans

Bibiis offers free and paid plans. Paid plans are available as recurring subscriptions (billed monthly or annually) and, where offered, as a one-time "lifetime" purchase. The features and prices of each plan are described at the point of purchase.

Billing

Payments are processed by a third-party payment processor; we do not store your full card details. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. You can cancel at any time from your account's subscription management; cancellation stops future renewals and takes effect at the end of the current paid period.

Price changes

We may change plan prices. For active subscriptions, we will give you reasonable advance notice, and any change applies from the next renewal; you may cancel before it takes effect.

Right of withdrawal (consumers)

If you are a consumer in the EU, you generally have 14 days to withdraw from a distance contract without giving a reason, under the Italian Consumer Code (Codice del Consumo). However, Bibiis is a digital service supplied immediately: by purchasing a paid plan and starting to use it, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the service has been fully performed, in accordance with Article 59 of the Codice del Consumo. To exercise the right of withdrawal where it applies, contact us at support@bibiis.it before you begin using the paid features.

Refunds

Except where required by mandatory consumer law, payments are non-refundable. If you believe you have been charged in error, contact us at support@bibiis.it and we will review your case.

Intellectual Property

The Service, including software, design, logos, text, and all content created by Bibiis, is the exclusive property of NVP Tech Srls and is protected by copyright and intellectual property laws. You do not acquire any ownership rights in the Service.

Your personal and financial data remains your exclusive property. We process it under a limited license solely for the purpose of providing the Service as described in these Terms and our Privacy Policy.

Data and Privacy

The collection and processing of your personal data is governed by our Privacy Policy. The Privacy Policy forms an integral part of these Terms.

In summary: we collect only the data necessary to provide you with the Service, we process your financial data in compliance with GDPR and PSD2, and we do not sell or share your data with third parties for marketing purposes.

Data Accuracy

Bibiis strives to provide accurate information based on data received from your banking institutions. However:

We do not guarantee the accuracy, completeness, or timeliness of the financial data displayed, as it depends on the availability and correctness of information provided by banks
Automatic transaction categorization via AI may contain errors. Users are encouraged to verify categorizations
Net worth and other aggregate calculations are estimates based on available data and may not reflect your complete financial situation

Limitation of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law:

Bibiis shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service
We shall not be liable for financial decisions made based on information provided by the Service
We shall not be liable for service interruptions, data loss, or errors in transaction categorization
Our total aggregate liability shall not exceed the amount you have paid for the Service in the 12 months preceding the event giving rise to the claim

Termination

You may stop using the Service and delete your account at any time from your profile settings or by contacting us at support@bibiis.it.

We reserve the right to suspend or terminate your account in the event of a violation of these Terms, fraudulent use, or if required by law.

Upon account deletion, your data will be removed in accordance with our Privacy Policy, subject to any applicable legal retention requirements.

Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the app or by email. Your continued use of the Service after notification constitutes acceptance of the modified Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of Italy, without prejudice to the mandatory consumer-protection provisions of the country in which you reside. For consumers, the competent court is that of the consumer's place of residence or domicile (foro del consumatore) under the Italian Consumer Code. For any other dispute, the competent court is that of Bari, Italy.

For consumers residing in the European Union, the option to use the European Commission's Online Dispute Resolution (ODR) platform remains available at <a href="https://ec.europa.eu/consumers/odr" target="_blank" rel="noopener">ec.europa.eu/consumers/odr</a>.
